Its all about the advertised price, as Gman stated.

Top shelf products, in Shimano's case, are ordered seperately from the rest of their stock,and must be shipped directly to the store the sells at retail, never the end user.

There are plenty of brandy new high end reels sold on ebay for far less than the minimum advertised price Shimano or Penn will allow, and certain bulk retailers will give cart discounts at checkout which will include high end reels, as mentioned. They also get cute with package deals, virtually "giving away the rod" as they state, when in actuality they take a set amount off the total purchase price, but claim it is only on the rod....perception to the end user in print only....

They cannot prevent the seller at end point from selling it at whatever he sees fit, hell he can discount it 50% on a case by case basis, an unlikely scenario, but not impossible. They cannot dictate to the retailer at what price he must sell, it is impossible to enforce. Only can tell them "no discounts, or no discounts beyond x, to stay above MRSP or dictated minimum selling price...

While I am still confused somewhat about this legal stuff, it seems from the practical side you are both right. I like to talk about electronics since I understand what is happening there from a practical side. Bose seems to have a fixed price for their electronics. They make great stuff and they know it. They do not feel there is anything out there that can compete with them. They set the price of what they want their product line to sell for. There is no wiggle room here. If you want it, like chainsaw says you are going to have to pay for it no matter where you go. However, a dealer could throw in say 20 feet of monster speaker wire to sweeten the deal and that is just fine too, just like chainsaw said. While this has not happened to my knowledge, suppose a dealership pisses off a manufacturer for what ever reason. All the manufacturer would have to do is say, "sorry we are currently out of stock and will fulfill your order when we catch up". You cannot make a sale on a product you do not have. Gman is right if there is a contract involved for the manufacturer to deliver a certain amount but I do not think this info is open to the public for viewing like government contracts. We really do not know what is going on between a manufacturer and a dealer other than a dealer can lose out if he upsets a manufacturer. Whether it is illegal or not, you really do not want to piss off a manufacturer because he does carry a big stick. It would seem to me that what Gman stated would be the right way for the legal progress to move. It just sounds to be more upstanding to me. However, when it comes to law and lawyers, I just get a headache thinking about it and just can't wait to go fishing. I am sorry I started this legal stuff but I am going to side with Gman on this one even if it is not enforced.

Thanks all for the good discussion. The suggestion of doing business with my local guy is good advice. I think the service commitment is important and over time he gives me good prices on other purchases and bait.

Great move, I think it was the best advice given. Your local shops are very important, support them when you can! Now if I could just sway towars the Shimano Tiagra, you'd be golden....jyus teasin, the Penns are great reels

Follow capt Dom's advice concerning your local tackle shops, but under no circumstances go to that legal web site should you wish to read up on it. What a convoluted 40 or 50 page mess of garbage that is. A normal intelligent person just cannot follow what these lawyers are trying to say. They awarded millions of bucks to a retail store that got into a pissing contest over the pricing of belts, then I read "The manufacturer has a number of legitimate options to achieve benefits similar to those provided by vertical price restraints. A manufacturer can exercise its Colgate right to refuse to deal with retailers that do not follow its suggested prices." I took that phase right out of the brief, word for word. When I see that much garbage thrown into a subject, is just means they do not know what the right answers are and they are just jockeying for position. Things can easily get out of hand in the courts. If I controlled a dealership, big or small, I would be scared of offending a manufacturer and toe the line. Getting myself into a courtroom situation would be a killer.
Now I know one of the reasons why I like fishing: "are they biting", "yep", "where", "over here". Things can be that simple!

Glad to see that we agree that our local shops are very important to our sport. I myself do not live on or neer the water (Some 60 Miles inland) and do not spend every day on the water. Because of that i sometimes have a hard time keeping up with what is going on out there. The shops that i choose to patronize help out with that when i need a bit of intell or need to know "Whats hot".. I don't expect to get exact and complete disclosure but if you point me in the right direction and i can figure it out.
Good shops like the hookup are all over. The owners and guys and gals that work them really work hard to keep the network of good info going and top quality gear and service available to us.

Ok Enough of this dribble
