Should anyone wish to see what a commercial log has to look like, see the scanned in copy. It's detail is nowhere near what the recreational log has in it. Please do not tell the DEP about the recreational logs as it might give them some ideas and I will have to purchased a thermometer. I did get into trouble with the DEP when I went out in a recreational mode and landed a single 32 inch striped bass and entered it into the commercial log (and submitted it.) It did not occur to me that the DEP did not want certain types of information entered into the commercial log. Anything caught while fishing for a species under the recreation umbrella is not to be entered. Anything not kept is not to be entered even if you kill (accidentally), it and toss it over the side. What draggers toss over the side is not counted nor entered! Never ever enter a fish that is caught in the commercial closed season, or ever enter a striped bass at any time even if you caught it while surf fishing. The laws that discriminate between commercial and recreational fishing had been as clear as mud until about four years ago. Commercial boats can fish for a fish species just the same as a recreational boat can. Four years ago, a dragger keying summer flounder caught two decent sized black sea bass in their net in addition to the summer flounder haul. They kept the two black sea bass for dinner. However, while the recreation black sea bass season remained open, the commercial season had been shut down. They were checked by the DEP and summoned to court for having two black sea bass aboard during the commercial closed season. The judge heard the defense given that they had no intentions of selling the the fish but just wanted to take them home for supper. The judge ruled after reading the DEP's bylaws, that he could not make heads or tails of the regulations and that ended the trial. The DEP, to prevent incidents like this from ever happening again, shot out a barrage of letters clarifying the rules under such circumstances. A commercial boat can fish for pleasure or commercial, but not at the same time. If fishing for pleasure, then he is bound by the same laws as everyone else. Should he have a 16 inch fluke and a 32 inch striper aboard his vessel he is either going to get fined for having an undersized fluke (recreation violation) or for having a striped bass (commercial violation). They cannot have their cake and eat it too! | ||
